Georgia DUI Less Safe

What you may not realize, however, is that due to Georgia DUI less safe laws, you can also be charged with drunk driving if your BAC is well below the legal limit.
As the name suggests, a “less safe” DUI offense is reserved for drivers whose mental and/or physical abilities have been impaired by alcohol to such an extent that they pose a threat to others. This means that, regardless of the amount of alcohol in your system, you may be legally impaired if you display erratic or dangerous driving behaviors—such as excessively speeding or driving on the wrong side of the road, for example.
Of course, police officers cannot simply pull over every vehicle on the road to determine whether a driver should be charged with DUI. Therefore, if you were stopped without cause (and keep in mind that driving late at night or in certain neighborhoods are not sufficient reasons for being pulled over), your DUI charges may not hold up in court.
Assuming you were pulled over for a valid reason, the officer must then witness something that leads him or her to believe you are under the influence of alcohol—for example, slurred speech, bloodshot eyes, an open container of alcohol, or the smell of alcohol on your breath. Only if such evidence is present can the officer request chemical testing in order to determine your BAC.
